1. Scope of this policy

This policy applies to anyone who visits magsart.buzz, requests a private commission, books a portrait sitting, enrolls in a studio class, joins a plein air weekend, purchases frame and finishing coordination, or attends a seasonal gallery showing arranged by MAGSART LLC. The developer and studio principal behind the work is MagsArt, and the legal entity responsible for the handling of personal information is MAGSART LLC at 1873 S Carrigan Cir, Salt Lake City - 84109-1475, United States.

The policy covers personal information you give directly to the studio and information the studio observes when you use the website, such as the pages you read and the general region your browser connects from. It does not govern the practices of any third-party payment processor, email carrier or analytics provider except to explain what the studio sends to them and asks them to destroy. Where a linked page or an external gallery takes you off magsart.buzz, that other site carries its own privacy responsibility.

2. Information the studio collects

To run a commission studio and studio classes well, MAGSART LLC only asks for what the work genuinely needs. Personal information falls into a few groups.

Identity and contact details

This group holds your full name, a delivery or home address where a frame must hang, an email address, and a phone number that can accept calls or messages. When a portrait is painted, the studio may also record a preferred name and any notes about how you like to be contacted, since portrait sittings succeed on comfort and courtesy.

Project content

Commission briefs describe the subject you want painted, the intended surface size, the emotional tone, reference photographs you supply, and a preferred timeframe. For a portrait, the record also captures the pose, clothing palette and background you choose. For classes, the record captures the age band of the learner, any medical or access notes that help you use the studio safely, and an emergency contact name and phone number for minors.

Correspondence and marketing preferences

Every email, phone message and site message is kept alongside your record so the studio can answer fully and refer back without asking you to repeat yourself. The studio records whether you want note of seasonal showings and commission openings, and honors your stop or removal request within one working week.

3. How the information is gathered

The studio gathers information the plain way: you give it.

Most of what is kept arrives through the website contact form at the contact page, through an email sent to helpdesk@magsart.buzz, through a voicemail on +19287193348, or through a face to face conversation at a studio visit or seasonal showing. Class enrollment records are completed on paper or on a shared form and then typed into the studio roster. Portrait sittings may add reference photographs that you hand over by message, by disk or in person.

Beyond what you provide, the website reads standard technical signals whenever a browser loads a page. Those signals include the internet protocol address of the device, the browser type and language, the date and time of each view, the referring page if one was used, and whether a page was read on a phone or a desktop computer. This technical layer is kept separate from your contact records unless you voluntarily tie them together by submitting a form.

4. Legal bases for processing

MagsArt, through MAGSART LLC, processes personal information only on a clear legal footing. For people in the European Union and the United Kingdom, the main foundation is performance of a contract, because a commission or a class is a contract you enter with the studio and the processing is needed to keep its promise of a finished painting or a taught lesson. Consent is the foundation for marketing messages, for cookies that are not strictly necessary, and for keeping your reference photographs longer than a project takes.

Legitimate interest supports the small amount of site analytics the studio keeps, because understanding which pages collectors value helps the studio improve without weakening anyone privacy. Legal obligation covers things such as tax receipts for payments received and any record a court or regulator compels. Where a basis is consent, you may withdraw it at any time by writing to helpdesk@magsart.buzz, and withdrawal does not undo work lawfully done before the withdrawal arrived.

5. How the studio uses personal information

Every piece of personal information is put to a named purpose, and none is sold, rented or traded.

  • Your name, email and phone make it possible to reply to an inquiry, schedule a sitting, send a class reminder and share the seasonal showing calendar.
  • Your address lets the studio coordinate framed delivery and, for local collectors, place a finished canvas on your wall.
  • Project briefs and your reference photographs tell the easel what to paint and keep the commission direction honest through the mid-point underpaint review.
  • An emergency contact name and number for minors protect a young painter should an accident happen at the bench.
  • Payment history proves what you paid for a work and settles warranty questions if a surface ever misbehaves.
  • Site analytics help the studio see which service pages are useful and which need rewording.

6. Communication about commissions and classes

The studio writes to you only for reasons tied to your work or your explicit interest. A commission message covers proposal approval, underpaint review scheduling, drying updates and delivery. A class message covers term dates, supply lists, weather changes for plein air weekends and payment reminders.

Separate from those service notes, the studio sends an occasional studio letter a few times a year announcing a seasonal showing or a commission opening. You receive that letter only if you asked for it, every letter carries a one-tap way to stop future messages, and stopping is instant. The studio never shares your email address with another exhibitor or dealer, and nobody outside MAGSART LLC has written access to your address book style records.

7. Disclosure to third parties

MAGSART LLC keeps personal information close and only passes a narrow slice outward when a task genuinely needs an outside hand.

Frame and finishing coordination may introduce the studio to a trusted local framer or a conservation varnish supplier, and that supplier sees no more than the artwork measurement and the delivery address needed to do the job. A plein air weekend may run on land managed by a park authority that requires an emergency contact list for group day visits, and that list stays with the authority only for the duration of the event. Email and hosting providers hold the technical infrastructure, meaning a message you send may pass through their servers, but the studio instructs them to treat the content as private correspondence.

If MAGSART LLC is acquired, merges or sells its studio business, personal records may transfer to the new operator under the same promises in this policy, and you will be told before the transfer completes. Outside those cases, the studio discloses personal information only where the law demands it, where a court orders it, or where you give clear and specific permission for a single disclosed act.

8. Payment handling and order records

Payments for commissions, classes and framing travel separately from your painting. The studio may accept a bank transfer, a card payment through a reputable payment processor, or cash and check for local studio transactions. When a processor is used, that processor handles the card number on its own secure network, and MAGSART LLC never sees or stores the full card number. The studio keeps only a plain record of the amount, the date and the last few digits so a receipt can be matched to the right commission slip.

An order record pairs that payment proof with a commission slip bearing your name, the work, and the agreed cost. These slips support warranty claims and tax accounting, so they are kept in the studio office for the period described in the retention section below. Should a payment dispute arise, the studio uses the order record to describe precisely what was promised and what was delivered.

9. Cookies and similar technology

The magsart.buzz site is deliberately light on tracking. A strictly necessary cookie may be set so that a single session stays tidy, and it expires when you close the browser. No advertising cookie, no behaviour profiling cookie and no social follow pixel is loaded on the homepage, the services page, the contact page, or the legal pages.

If the studio later adds an optional cookie, it will ask for consent first and offer an equal experience for those who decline. You can manage or clear cookies inside your own browser at any time, and clearing them will not hide a wall or cancel a commission. The studio recommends you regard any third-party widget on a linked page as governed by that provider own cookie rules, not by this policy.

10. Log data and site analytics

Web servers keep a short technical log to keep the site healthy. That log holds an internet protocol address, the requested page, a browser description and a timestamp. MAGSART LLC uses this log only to notice faults, guard against abuse and understand general reading patterns, and it reviews the log at an aggregate level rather than name by name.

Where aggregate analytics are used, the studio favours tools that accept a privacy-respecting setting so individual browsing is not stitched into a profile. The studio does not merge analytics records with your commission email address, and a person who never contacts the studio leaves no named trace beyond the anonymous technical layer that any site sees.

11. Photography and reference materials

Portrait sittings and commissions often lean on reference photography, and this material is sensitive, so it is handled with care. Photographs you supply for a portrait are used only to paint that portrait and to guide its color notes. Originals stay yours, the studio holds copies only where a project is unfinished, and after delivery the copies are erased from the studio drive unless you ask, in writing, for them to be kept as a record.

The studio may photograph its own finished works for a portfolio, a catalogue or a seasonal showing preview. A finished painting is not a photograph of you, so a general portfolio image does not constitute personal data of the sitter. Should the studio ever want a photograph that clearly shows a visitor or a class student, it will ask permission at the moment and will not publish an image that includes a minor without parental written consent.

12. Privacy for children

Children and teenagers are welcome in the studio studio classes, and privacy for children matters as much as privacy for adults. MAGSART LLC does not knowingly collect personal information from a child under thirteen without the involvement of a parent or guardian. All enrollment for the junior and teen class bands is done in the name and contact details of an adult, and the adult remains the single responsible point of contact.

Where the studio processes limited information about a child, such as a first name for a name tag and an emergency contact route, that information is kept inside the studio, is never offered to an advertiser, and is deleted promptly once the child is no longer enrolled. A parent or guardian may ask to see, correct or erase any record held about their child by writing to helpdesk@magsart.buzz, and the studio will act on that request without delay or charge.

13. Where the data is stored

Personal information gathered by MAGSART LLC is stored in the studio systems and on hosting infrastructure located in the United States. Commission slips, class rosters and correspondence are kept on password-protected studio machines and a secured studio-backed folder. Site files and forms that the website relies on are served from the web host that carries magsart.buzz.

Because the studio does serve enquiries from collectors who may live in the European Economic Area, the studio works to keep processing fair under the applicable protection regime. Transferring a name across a border for the single purpose of answering that collector does not dilute the promises here: the studio stores the smallest set, protects it with strong authentication, and never enriches it through a data broker. Anyone outside the United States is free to ask where their record rests before sharing it.

14. How long the record is kept

Records are not kept forever, and the studio keeps only what a lawful task still needs.

  • An ordinary inquiry that does not become a project is deleted twelve months after the last message, so nothing lingers that never grew.
  • A completed commission record, including payment proof and warranty notes, is kept for seven years from delivery to satisfy tax and warranty duties, then purged.
  • Reference photographs supplied for a portrait are erased once the finished work is delivered and approved, unless you ask for them to stay.
  • A class roster is refined each term, and an inactive student record is removed two years after the last class.
  • Site logs are overwritten after a brief rolling window measured in weeks, not years.

On the day a retention period closes, the studio deletes the record in place and does not withdraw it from the trash for analytics or sale. Where erasure is technically awkward because a backup still holds an older copy, that copy is ignored and expires naturally with the next full backup rotation.

15. Security safeguards

Stewardship begins with plain discipline. Studio machines are locked when the bench is empty, drives are encrypted, passwords are long and unique, and the phone number is guarded by a human rather than left on a public board with an open voicemail trap. Access to personal folders is limited to the people who actually answer a commission or teach a class, and each of those people signs the same quiet duty of care.

The website is served over secure transport so a form submission is scrambled in transit, and emailed approval slips are sent only to the address you confirmed. The studio checks its own habits rather than waiting to be told: sensitive reference photography is copied to the finished-work archive and never left on a shared device. No security measure is absolute, and in the unlikely event of a breach affecting personal information, MAGSART LLC will notify every affected contact promptly and describe what was exposed and what is being done.

16. Your privacy rights

This policy is written to hand you control, so the studio keeps your rights near and usable.

  1. The right of access, so you can request a copy of the personal information the studio holds about you.
  2. The right to rectification, so you can correct a name, an address, a phone number or a learning note that has gone stale.
  3. The right to erasure, so you can ask the studio to delete personal information that no longer serves a lawful task.
  4. The right to restriction, so you can pause a particular use while a question is settled.
  5. The right to data portability, so a record that the studio holds on consent can be returned to you in a plain and readable form.
  6. The right to object, so you can stop marketing mail and can veto a non-essential use based on legitimate interest.

To exercise any right, write to helpdesk@magsart.buzz and say which right you are using. The studio will confirm it has received your request within five working days and will act within one month, keeping you posted if a genuine complication slows the answer. There is no fee for a first reasonable request, and the studio never punishes a person who complains or asks.

17. Changes to this policy

The studio may revise this policy when the law shifts, when a new service is added, or when the way records are kept improves. Any change is posted on this page with a fresh review date at the top, and a material change to the way personal information is used will be announced by a clear note on the homepage as well as by email to collectors and students whose consent the change touches.

Continuing to visit the site or to work with the studio after a posted change means you accept the revised policy for activity that follows the change. Work already begun when a policy changes is still governed by the policy that stood on the day the commission or class was booked, so a change never quietly rewrites an existing arrangement. The studio keeps a small archive of past policy dates for anyone who wants to check what a prior year promised.

Because the studio principal is the artist MagsArt, a quiet personal reply usually comes from the person who would hold the brush, not from a faceless form letter. Your record matters because the trust between a collector and a studio is as easy to lose as a bare canvas is to waste, and MAGSART LLC guards that trust the way it guards the drying rack, with steady attention and no shortcuts.
